Demand Progress SMS Terms of Service
1. By voluntarily providing your mobile phone number to Demand Progress Action Inc. and/or Demand Progress Education Fund (collectively, “Demand Progress,” “us” or “we”), you agree to receive text messages (also known as “SMS messages”) at such mobile phone number with updates, event invitations, donation asks, voting reminders, action opportunities, and other important information.
2. Message frequency will vary but messages may be recurring.
3. You can opt out at any time. Just text the word “STOP” in response to any text message received. After this, you will no longer receive text messages from us. If you want to join again after opting out, just sign up as you did the first time.
4. If you are experiencing issues with any of our messaging programs, you can reply to any SMS message with the word “HELP” for more assistance, or you can get help directly by emailing [email protected].
5. Neither we nor any wireless carriers that enable our SMS messaging program shall be liable for delayed or undelivered messages.
6. Text message and data rates may apply for any text messages sent to you from us and to us from you. You are responsible for all such charges and fees. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
7. We may change any short code or telephone number we use to operate our SMS program at any time. You acknowledge that any messages, including any “STOP” requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
8. You agree to provide us with valid contact information. If you change your mobile phone number, you agree to opt out of our SMS program prior to changing your mobile number.
9. You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through our SMS program, any errors in such information, and/or any action you may or may not take in reliance on such information or our SMS program.
10. You release, and agree to indemnify, defend, and hold harmless, Demand Progress from and against any claims (and any related losses, liability, costs, and expenses, including reasonable attorneys’ fees) arising from your participation in our SMS program, including, without limitation, any privacy or tort claims, claims made under the federal Telephone Consumer Protection Act or any state law equivalent(s), and claims resulting from you providing us with contact information that is not your own or from your failure to notify us of a change in the information you have provided.
11. OUR SMS PROGRAM IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOU EXPRESSLY AGREE THAT YOUR PARTICIPATION IN OUR SMS PROGRAM IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND GUARANTEES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO OUR SMS PROGRAM.
12. IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR PARTICIPATION IN OUR SMS PROGRAM. WITHOUT LIMITING THE FOREGOING, YOU AGREE THAT IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DAMAGES IN EXCESS OF (IN THE AGGREGATE) FIFTY U.S. DOLLARS ($50.00) BASED ON ANY CAUSES OF ACTION ARISING OUT OF YOUR PARTICIPATION IN OUR SMS PROGRAM. THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
13. We may modify or cancel our SMS program, or any features of such program, at any time without notice. We may also modify these SMS Terms of Service at any time and your continued participation in our SMS messaging program following the effective date of any such changes shall constitute your acceptance of such changes.
14. These SMS Terms of Service shall be governed by the laws of the State of Maryland, without regard to conflict of laws rules.
